1. About these terms
These Terms of Use ("Terms") govern access to AlignmentX ("AX"), operated by PURPLE CRAYOLÁ LTD, 82A James Carter Road, Mildenhall, Suffolk, IP28 7DE, United Kingdom, company number 15615450.
By creating an account, continuing with a supported sign-in provider, purchasing or using AX, you agree to these Terms. If you use AX for an organisation, you confirm that you are authorised to do so and that any separate written agreement with that organisation also applies.
If you do not agree, do not create an account or use AX.
2. Eligibility and accounts
You must have legal capacity to enter into these Terms and provide accurate registration information. Organisations arranging access for anyone under 18 are responsible for appropriate authorisation, supervision and lawful processing.
Keep your password and sign-in methods secure. You are responsible for activity carried out through your account unless caused by our failure to use reasonable care. Tell us promptly at hello@thealignmentx.com if you suspect unauthorised access.
Accounts are personal unless AX expressly provides an organisation, facilitator, coach or administrator role. Do not share credentials or impersonate another person.
3. What AX provides
AX provides reflective assessments, generated reports, development tools, journals, plans, learning experiences, coaching workflows and related services. Available features may depend on your purchase, role, organisation, location and current product configuration.
We may improve, replace or discontinue features where reasonably necessary. We will take reasonable steps to avoid materially reducing a paid service during its stated access period without notice or an appropriate remedy.
4. Developmental—not medical or professional—information
AX assessments and reports support self-reflection, learning and development. They are not medical, psychological or psychiatric diagnoses; therapy; crisis support; legal, financial or employment advice; or a substitute for a qualified professional.
Results are based on the responses and scoring framework used at the time. They should not be treated as fixed labels, guarantees or the sole basis for decisions with legal or similarly significant effects.
If you are in immediate danger or experiencing a medical or mental-health emergency, contact the appropriate emergency service or qualified professional. AX is not an emergency service.
5. Acceptable use
You must not:
- Break the law or another person's rights.
- Access another person's account or restricted information without permission.
- Upload malware, probe security, disrupt the service or bypass access controls.
- Scrape, bulk-export, reverse engineer or reproduce AX except where law expressly permits.
- Use assessment content to build or train a competing product or model without written permission.
- Submit information you are not authorised to provide.
- Harass, discriminate against or harm participants, coaches, facilitators or staff.
- Use AX results as the sole basis for employment, credit, insurance, healthcare or other high-impact decisions.
We may investigate misuse and suspend or restrict access where reasonably necessary to protect AX, users or others.
6. Assessments, reports and your content
You retain rights in original journal entries, reflections and other content you submit. You grant us a limited licence to host, process, reproduce and display that content only as needed to provide, secure and improve AX and meet legal obligations.
PURPLE CRAYOLÁ LTD and its licensors retain rights in AX software, assessment questions, scoring methods, frameworks, reports, branding, course materials and other service content. Subject to these Terms, you receive a personal, limited, non-exclusive, non-transferable licence to use purchased or assigned materials for your own permitted development purposes.
Do not publish, sell, distribute or reproduce assessment questions, scoring logic, reports or learning materials except with written permission or where mandatory law allows it.
7. Organisations, facilitators and coaching
Organisation administrators, facilitators and coaches must use participant information only for authorised and lawful purposes, respect configured visibility limits and maintain confidentiality.
Coaching availability, assignment, scheduling and meeting providers may change. Unless expressly agreed in writing, AX does not guarantee a particular coach, outcome or appointment time.
Users remain responsible for their own choices and actions following an assessment, report, learning activity or coaching session.
8. Prices, payments and refunds
Prices, currencies, taxes and included access are shown at checkout or in an applicable organisation agreement. Payments may be processed by Stripe, PayPal, Revolut Pay, Paystack or another displayed provider under that provider's terms.
You authorise the selected provider to charge the amount shown. AX does not store complete card details. Access may be delayed while a payment is pending or being verified.
Refunds, cancellations and statutory withdrawal rights are handled according to the offer shown at purchase and applicable consumer law. Contact hello@thealignmentx.com if you believe a payment was incorrect or a purchased service was not supplied.
Nothing in these Terms limits rights that applicable consumer law does not allow us to exclude.
9. Third-party services
AX may connect to services such as payment providers, Google, video-meeting providers, email services, storage providers and learning integrations. Their own terms and privacy policies may apply. We are not responsible for a third-party service outside our reasonable control, but this does not limit responsibility that cannot lawfully be excluded.
10. Availability and security
We aim to provide a reliable and secure service, but AX may occasionally be unavailable for maintenance, updates, provider outages or events beyond reasonable control. We do not promise uninterrupted or error-free operation.
You should keep copies of content you cannot afford to lose. Report suspected vulnerabilities privately to hello@thealignmentx.com and do not exploit them.
11. Privacy
Our Privacy Policy explains how we handle personal information. Our Cookie Notice explains cookies, advertising technologies and your choices.
12. Suspension and ending access
You may stop using AX and request account closure through available profile controls. We may suspend or end access where you materially breach these Terms, create security or legal risk, fail to pay an amount due, or where a providing organisation ends your entitlement.
Where reasonable, we will give notice and an opportunity to remedy the issue. Provisions intended to continue—such as intellectual-property, payment, liability and dispute provisions—survive termination.
13. Responsibility and liability
We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to those protections, AX is provided for reflective and developmental use. We are not responsible for losses caused by treating AX content as medical, legal, financial, employment or other professional advice; unauthorised account use resulting from your failure to secure credentials; or third-party services outside our reasonable control.
For business and organisation users, and to the extent permitted by law, our aggregate liability arising from AX during any 12-month period will not exceed the fees paid for the affected service during that period. We are not liable to business users for indirect or consequential loss, loss of profit, revenue, goodwill or anticipated savings.
Consumer rights and remedies that cannot legally be limited remain unaffected.
14. Changes
We may update these Terms to reflect service, legal or security changes. Material changes will be communicated where appropriate. Continuing to use AX after the effective date means the updated Terms apply, except where law requires a different form of agreement.
15. Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, except that consumers may retain the right to bring proceedings in the part of the United Kingdom or other country where they live where mandatory law provides that right.
